GENERAL TERMS AND CONDITIONS – DAIZ PADEL

(trading name of DAIZ SPORTS B.V.)

Article 1 – Definitions
Entrepreneur: the legal entity acting in the course of business and offering products and/or services; in these terms: DAIZ SPORTS B.V., operating under the name DAIZ PADEL.
Customer: any natural or legal person entering into an agreement with the entrepreneur.
Consumer: a natural person acting outside business or profession.
Business customer: a customer acting in the course of business.
Distance contract: any agreement concluded between entrepreneur and customer via the webshop, without simultaneous physical presence.
Right of withdrawal: the statutory right of the consumer to withdraw from the agreement within the legal period.

Article 3 – Applicability
These terms apply to all offers, orders and agreements.
Consumer- or business-specific provisions are explicitly stated.
Customer terms are excluded.
Deviations require written agreement.

Article 4 – Offer
All offers are non-binding and subject to obvious errors.
Descriptions and images are indicative.
Obvious mistakes are not binding.

Article 4a – Consumers only
The offer clearly states price, shipping costs, withdrawal rights and delivery method.

Article 5 – Agreement
An order constitutes an offer by the customer.
Automatic confirmations are not acceptance.
The agreement is concluded upon explicit acceptance by DAIZ PADEL.
Orders may be refused or cancelled in case of errors or misuse.

Article 6 – Withdrawal (consumers)
A 14-day withdrawal period applies.
Products must be handled with care.

Article 7 – Withdrawal costs (consumers)
Return costs are borne by the consumer.
Refund within 14 days.
Value reduction may be charged.

Article 8 – Prices
Prices include VAT.

Article 8a – Business customers
Prices exclude VAT unless stated otherwise.

Article 9 – Conformity and warranty
Products comply with the agreement and applicable law.
Warranty lapses in case of misuse or modification.

Article 9a – Consumers
Any warranties do not affect statutory consumer rights.

Article 10 – Delivery
Delivery to the specified address.
Delivery times are indicative and not binding.
Risk transfers upon delivery to consumers.

Article 11 – Payment
Payment is due immediately via available methods, unless agreed otherwise.
If invoice terms are agreed for business customers, a 14-day payment term applies.

Article 12 – Retention of title
Products remain the property of the entrepreneur until full payment has been received and shipment has been confirmed by email.

Article 13 – Liability and force majeure
Liability is limited to the invoice amount.
No liability in case of force majeure.

Article 14 – Complaints
Complaints must be submitted within a reasonable time.
A response will be provided within 14 days.

Article 15 – Governing law
Dutch law applies to all agreements.
